These Terms & Conditions ("Terms") govern your access to and use of Capital & Competence University, CapitalAndCompetenceUniversityLLC, its website, courses, mentorship services, live sessions, community spaces, digital tools, and related services (collectively, the "Services"). By accessing or using the Services, you agree to these Terms.

1. Educational Nature of Services

Capital & Competence University is a digital educational and mentorship institution. The Services are provided for educational, informational, and developmental purposes.

CCU is not:

  • a broker;
  • a bank;
  • a guaranteed income program;
  • a guarantee of funded account success;
  • a signal-only service;
  • a substitute for independent judgment; or
  • account management, unless expressly stated in a separate written agreement.

Nothing in the Services constitutes personalized financial, investment, legal, tax, or accounting advice.

2. Eligibility and Age Restrictions

You must be legally capable of entering into a binding agreement in your jurisdiction to use the Services. CCU is not intended for minors. By using the Services, you represent that you are an adult under the laws of your jurisdiction and that your use of the Services is lawful where you are located.

3. Accounts and Access

Certain Services may require account creation. You are responsible for maintaining the confidentiality of your login credentials and for activities that occur under your account.

After enrollment, students may be taken directly into the course curriculum. Some areas of the Services may still be subject to progression rules, quizzes, mentorship level, program structure, or other access requirements.

We may suspend, restrict, archive, deactivate, or terminate access where reasonably necessary, including if:

  • you violate these Terms or related policies;
  • payments fail, are reversed, or are disputed improperly;
  • you misuse the Services or the community;
  • your conduct harms other users, staff, or the learning environment;
  • your account remains inactive for an extended period;
  • security, legal, operational, or compliance reasons require action; or
  • the relevant program, membership, or access period has ended.

4. Programs, Mentorship, and Access Levels

CCU may offer multiple forms of access, including but not limited to:

  • self-paced course programs;
  • limited mentorship offers;
  • dedicated mentorship pathways;
  • group mentorship;
  • one-on-one mentorship;
  • live sessions and webinars;
  • community access;
  • in-person mentorship opportunities; and
  • structured capital-related pathways such as the Applied Capital Program.

Not all programs include the same features. Access levels may vary based on:

  • program selected;
  • payment status;
  • eligibility;
  • scheduling;
  • progression;
  • capacity;
  • mentorship type; and
  • any additional stated requirements.

5. Progression, Quizzes, and Practical Work

Certain areas of the curriculum may require sequential progression, successful quiz completion, practical work, or demonstrated understanding before later sections become available. CCU may use such progression rules to help preserve the integrity of the educational process.

6. Self-Paced Learning and Live Learning Environments

Where applicable, students may move through course materials at their own pace. Live sessions, webinars, mentorship environments, and interactive educational spaces are also part of the broader learning experience.

Live sessions may be recorded. Recording notices may be provided within the platform, in the session environment, or through related communications. By participating, you acknowledge and consent to recording where permitted by law.

7. Payments, Renewals, and Refunds

Prices, payment structures, installment options, renewals, and promotions may change at any time unless otherwise stated.

Refunds, cancellations, rescheduling, and billing treatment are governed by the applicable Refund Policy, specific checkout terms, or other written offer terms.

If recurring billing applies, you are responsible for canceling before the next renewal date if you do not wish to continue. Failure to do so may result in the next billing period being charged in accordance with the applicable subscription terms.

8. Community Rules and Conduct

If you access the CCU community, you agree to use it respectfully, lawfully, and in a way that supports a serious educational environment.

You must not:

  • harass, threaten, bully, or abuse others;
  • post unlawful, defamatory, hateful, discriminatory, or harmful material;
  • impersonate another person or misrepresent your identity;
  • spam, scam, exploit, or improperly solicit members;
  • share confidential or private information without permission;
  • upload malicious code, harmful files, or disruptive content;
  • copy, leak, resell, or redistribute paid materials or private community content without authorization; or
  • interfere with the integrity of the educational environment.

CCU may moderate, remove content, restrict features, suspend access, or terminate accounts where reasonably necessary to protect the community and Services.

9. Intellectual Property

All course materials, videos, recordings, frameworks, curriculum content, trade breakdowns, written materials, graphics, logos, branding, methods, educational structures, and related content are owned by CCU or its licensors unless otherwise stated.

You may not copy, reproduce, republish, resell, distribute, modify, exploit, or disclose our materials except as expressly permitted in writing.

10. User Content and Community Participation

You retain ownership of content you submit, but you grant CCU a non-exclusive, worldwide, royalty-free license to host, use, reproduce, display, and process that content as reasonably necessary to operate the Services, provide community functionality, support educational delivery, moderate the platform, and improve the user experience, subject to applicable law and our Privacy Policy.

11. No Guarantee of Results

CCU does not guarantee profits, funded account approval or retention, income, withdrawals, consistency of performance, business success, or any particular financial or lifestyle outcome. Trading and market participation involve risk, and outcomes depend on many factors, including discipline, risk management, psychology, market conditions, execution quality, and personal decision-making.

12. Educational Signals, Commentary, and Market Information

Where CCU provides educational signals, market commentary, chart ideas, live analysis, or trade breakdowns, those materials are provided for learning and developmental purposes. They are not guaranteed trade instructions and do not remove the user's responsibility to exercise independent judgment and risk management.

13. Applied Capital Program and Capital-Related Pathways

Where offered, the Applied Capital Program or similar pathways are part of a structured educational and execution-linked ecosystem.

Unless expressly stated in a separate written agreement:

  • ACP is not account management;
  • ACP is not guaranteed income;
  • ACP is not a promise of profits;
  • members maintain full control of their own trading accounts at all times;
  • participation may involve account connection through a copier or recommended platform;
  • drawdowns and losses are possible;
  • execution differences may occur between accounts; and
  • participation may depend on eligibility, readiness, progression, and additional requirements.

Fees connected to ACP are fees for structured participation, educational access, reporting environments, execution-linked membership features, and related service delivery. They are not protected investment balances, not deposits, and not guarantees of return.

14. In-Person Sessions, Travel, and Events

If CCU offers in-person mentorship, events, tours, or travel-related educational experiences, participation may be subject to additional terms concerning scheduling, conduct, travel logistics, safety, payment, and cancellation. Unless expressly stated otherwise in writing, CCU is not responsible for third-party travel, lodging, visa, transportation, or related arrangements made by the user.

15. Third-Party Platforms and Services

The Services may rely on or integrate with third-party platforms, payment processors, course hosts, community tools, analytics providers, communication systems, broker-related tools, or other technologies. CCU is not responsible for the independent acts, outages, limitations, policy changes, or failures of third-party services.

16. Disclaimer of Warranties

To the fullest extent permitted by law, the Services are provided on an "as is" and "as available" basis. CCU makes no warranty that the Services will be uninterrupted, error-free, available at all times, or suitable for every user's objectives.

17. Limitation of Liability

To the fullest extent permitted by law, CCU and its affiliates, officers, employees, contractors, representatives, and related parties will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for loss of profits, revenue, opportunity, goodwill, or data arising out of or related to your use of the Services.

To the fullest extent permitted by law, CCU's total liability for any claim arising out of or relating to the Services shall not exceed the amount you paid to CCU for the specific Service giving rise to the claim during the 12 months before the event giving rise to the claim.

18. Indemnification

You agree to indemnify and hold harmless CCU and its affiliates, personnel, contractors, and representatives from claims, liabilities, damages, losses, and expenses arising out of your misuse of the Services, your violation of these Terms, your violation of applicable law, or your violation of any third-party rights.

19. Inactivity and Termination

CCU may review, archive, deactivate, or terminate accounts that remain inactive for an extended period. Unless a specific program states otherwise, inactivity of approximately 12 months may result in account review or access removal. Inactivity does not create any refund right.

We may also suspend or terminate access for operational, legal, payment, compliance, conduct, or security reasons. Sections intended to survive termination will continue in effect.

20. Governing Law and Disputes

These Terms shall be governed in a manner consistent with the laws and legal requirements applicable to the business operations of CapitalAndCompetenceUniversityLLC in the United States and Jamaica, without regard to conflict of law principles, unless mandatory law requires otherwise.

Any dispute, claim, or controversy shall be handled in a court or forum of competent jurisdiction connected to the United States or Jamaica, unless you and CCU agree to another method such as arbitration or mediation, or unless applicable law requires otherwise.

21. Changes to These Terms

CCU may update these Terms from time to time. Updated versions become effective when posted unless otherwise stated. Continued use of the Services after changes become effective constitutes acceptance of the updated Terms.
